Orders and Customer Responsibilities
When placing an order through our website, you confirm that:
You are legally entitled to enter into the purchase transaction.
You are authorised to use the selected payment method.
The information you provide, including contact and vehicle details, is accurate and complete.
The products or services you order are intended for delivery or fitting within our advertised service area.
You have checked the tyre size, specifications and compatibility with your vehicle before ordering.
Our current service area is Victoria, Australia, subject to availability and the locations specified on our website.
Orders are generally processed during business days. Processing times may vary depending on stock availability, payment verification, appointment availability and other operational requirements.
We reserve the right to decline, hold or cancel an order where reasonably necessary, including where a product is unavailable, pricing information is incorrect, payment cannot be verified or fraudulent activity is suspected. If payment has already been received for an order that we cancel, we will arrange an appropriate refund in accordance with applicable law.
Prices and GST
Unless otherwise stated, prices displayed on our website are in Australian dollars (AUD) and include Goods and Services Tax (GST) where applicable.
Product prices may include delivery and tyre fitting at the nominated address where this is expressly stated in the relevant product listing or offer.
Additional charges may apply where disclosed, including applicable payment surcharges or fees associated with cancellations, failed appointments or other services.
We make reasonable efforts to ensure that prices and product information are accurate. If an error is identified after an order is placed, we will contact you to explain the issue and discuss the available options. We will not require you to pay an undisclosed additional amount without an appropriate basis under the purchase agreement and applicable law.
Prices and promotions may change without prior notice. Changes will not remove any rights you have under applicable law in relation to an existing order.
Payment Methods
Available payment methods may include:
Credit and debit cards, including Visa, Mastercard and American Express, subject to availability.
Humm.
Zip.
Afterpay.
Payment methods may change from time to time and may not be available for every transaction.
By submitting payment details, you confirm that you are authorised to use the selected payment method and authorise payment of the amount properly payable for your order.
We may carry out reasonable verification checks if an order appears suspicious or potentially fraudulent. Orders may be delayed or declined while such checks are completed.
Third-party payment providers, including Humm, Zip and Afterpay, operate under their own terms and conditions. Questions about instalments, payment schedules, fees or account management should be directed to the relevant provider.
Where reasonably required for a tyre fitting appointment, we may ask to verify the original payment method or transaction. Any verification will be handled in accordance with applicable privacy and payment-security requirements.
Product Information and Availability
We aim to ensure that product descriptions, specifications, images and prices on our website are accurate and up to date.
However, product images may be illustrative and may differ from the actual product in appearance or presentation. Unless expressly included in the listing, accessories, wheels, rims or other items shown in product images are not included in the purchase price.
Product descriptions may incorporate information provided by manufacturers or suppliers. We make reasonable efforts to present this information accurately, but customers should confirm that a product meets their requirements before ordering.
Product availability may change without notice. If a product becomes unavailable after an order is placed, we will contact you to discuss appropriate options, including a refund where applicable.
Nothing in this section excludes or limits any consumer guarantee or other right that cannot legally be excluded under Australian Consumer Law.
Tyre Selection and Vehicle Compatibility
It is the customer's responsibility to provide accurate vehicle details and check that the selected tyres are suitable for the intended vehicle.
Before placing an order, please check:
Tyre size and dimensions.
Load index and speed rating.
Vehicle manufacturer recommendations.
Compatibility with the vehicle's wheel and rim specifications.
Any relevant roadworthiness or legal requirements.
If you are unsure which tyres are suitable, contact Express Tyres & Auto before ordering.
Selecting tyres with a different size or specification from those recommended for your vehicle may affect handling, clearance, speedometer accuracy, safety or roadworthiness. We may decline to fit tyres where the proposed fitment is unsuitable, unsafe or inconsistent with applicable requirements.
If you request a tyre size or specification that differs from the manufacturer's recommendation, we may require additional information before confirming the order or fitting appointment.
Delivery and Fitting
Delivery and fitting arrangements depend on the product purchased, the nominated address, availability and the service area advertised at the time of ordering.
Where delivery and fitting are included in a product price, the relevant listing or order confirmation will specify the applicable arrangements.
Customers must ensure that:
The nominated address is accurate and accessible.
The vehicle is available at the agreed appointment time.
The vehicle can be accessed safely by the technician.
Relevant locking wheel nuts, security keys or other necessary equipment are available.
The correct tyres have been selected and ordered.
If an appointment cannot proceed because the vehicle is unavailable or inaccessible, the wrong tyres have been ordered, a required locking wheel nut or key is missing, or another customer-related issue prevents the work from being completed, an additional attendance or cancellation fee may apply as described below.
We will communicate any applicable charges and available options in accordance with these terms and applicable law.
Cancellations, Rescheduling and Failed Appointments
Please contact us as soon as possible if you need to cancel or reschedule an order or appointment.
Our standard fees, where applicable and disclosed before the order or booking is confirmed, are:
Cancellation fee: $59 for a customer cancellation of an order or appointment.
Failed attendance fee: $79 where a technician attends but cannot complete the booked service due to circumstances such as an inaccessible or unavailable vehicle, incorrectly selected tyres or missing required equipment.
These fees are subject to applicable law and must be applied consistently with any rights you have under Australian Consumer Law. They will not apply where prohibited by law or where a refund or other remedy is required.
If you are unsure about tyre specifications or your appointment requirements, please contact us before confirming your booking.
Shipping and Processing Fees
Shipping and processing fees, if applicable, will be disclosed during the ordering process or in your order confirmation.
Any fee described as non-refundable is subject to applicable law. Nothing in these terms excludes a refund or remedy where it is required by law, including in circumstances involving a failure to supply, a faulty product or another qualifying consumer guarantee issue.
Product Warranties and Australian Consumer Law
Products purchased from Express Tyres & Auto come with consumer guarantees that cannot be excluded under the Australian Consumer Law (ACL).
Depending on the circumstances, if a product has a qualifying failure, you may be entitled to a repair, replacement, refund or other remedy under the ACL.
The remedy available will depend on the nature of the failure and the applicable legal requirements.
Manufacturer warranties may also apply to individual tyre brands or other products. These warranties operate in addition to any consumer rights that cannot legally be excluded.
Product performance and lifespan may depend on factors such as vehicle condition, driving style, tyre pressure, wheel alignment, tyre rotation, maintenance and road conditions. Failure to follow appropriate maintenance recommendations may affect a manufacturer's warranty where permitted by its terms and applicable law.
Nothing in this section limits your statutory rights or suggests that a valid consumer guarantee claim can be rejected solely because routine maintenance has not been performed.
Damaged, Faulty or Incorrect Products
If you believe a tyre or another product supplied by us is damaged, faulty or different from what you ordered, please contact us as soon as reasonably possible.
Please provide your order details and a description of the issue. Photographs or other supporting information may help us assess your enquiry.
We will review the matter and explain the next steps in accordance with the relevant product warranty, the Australian Consumer Law and any other applicable requirements.
This process does not limit any rights or remedies available to you under applicable law.
Returns and Refunds
Returns, exchanges and refunds are assessed according to the circumstances of the purchase, the product condition, any applicable manufacturer warranty and your rights under Australian Consumer Law.
We may decline a change-of-mind return where permitted by law, including where a product is unsuitable for return under an applicable policy or has been used or fitted in a manner that affects its resale condition.
However, we will not refuse a return, refund, replacement or other remedy where the customer is legally entitled to it, including for qualifying faulty or misdescribed products.
Please contact our team before returning a product so we can explain the appropriate process.
Delivery Delays and Events Outside Our Control
We make reasonable efforts to fulfil orders and appointments within the communicated timeframe. However, delays may occur due to circumstances outside our reasonable control, including severe weather, floods, fires, accidents, transport disruptions, supplier shortages, industrial action, government restrictions or other significant events.
If an event affects your order, we will take reasonable steps to communicate the delay and discuss available options.
Where we cannot fulfil an order, any cancellation and refund will be handled in accordance with the purchase agreement and applicable law.
Nothing in this section removes any consumer rights or obligations that apply in the circumstances.
